Terms of Service: Gogate Hapus

This website is operated by Gogate Hapus. Throughout the site, the terms “we”, “us” and “our” refer to Gogate Hapus. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

1. Eligibility

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. Our products are intended for lawful consumption and you may not use our mangoes for any unauthorized or illegal purpose.

2. Natural Product Disclaimer (The "Hapus" Clause)

Mangoes are a natural, agricultural product.

  • Variations: You acknowledge that size, color, skin blemishes, and sweetness may vary from fruit to fruit. Photos on the website are for representation only.

  • Ripening: We often ship mangoes in a semi-ripe state to prevent damage during transit. It is the customer's responsibility to follow the ripening instructions provided with the box. We are not liable for fruit quality issues caused by premature cutting or improper storage after delivery.

3. Pricing and Payments

  • Payment Gateway: All online payments are processed via Razorpay. We accept UPI, Credit/Debit Cards, and Net Banking.

  • Price Changes: Mango prices fluctuate based on market arrivals. The price at the time of your order is final. We reserve the right to change prices without notice for future orders.

  • Taxes: All prices listed on the website are inclusive of applicable taxes unless stated otherwise.

4. Pre-Orders and Seasonal Availability

As mangoes are seasonal, we may accept "Pre-orders."

  • Delivery Timelines: Any delivery dates provided for pre-orders are estimates. Harvest depends on weather conditions (unseasonal rain, heatwaves, etc.).

  • Stock Outs: If we are unable to fulfill your order due to a crop failure or quality issues, we will provide a full refund via the original payment method.

5. Accuracy of Billing and Shipping Information

You agree to provide current, complete, and accurate purchase and account information.

  • Wrong Address: We are not responsible for non-delivery if the address or phone number provided is incorrect.

  • Delivery & Unavailability: We utilize local delivery partners. The delivery partner will attempt to contact you at the phone number provided at checkout. Since mangoes are highly perishable, if you are unreachable or unavailable to receive the package after reasonable attempts by the driver, the order will be marked as "Delivered" or "Cancelled" without a refund. We do not attempt next-day re-delivery for fresh produce.

  • Service Area: We currently only fulfill orders within specific delivery zones in Pune, Maharashtra. We reserve the right to immediately cancel and refund any orders placed with delivery addresses outside our active, designated pincodes.

6. Prohibited Uses

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others.

7. Limitation of Liability

Gogate Hapus shall not be liable for any indirect, incidental, or consequential damages resulting from the use or consumption of our products. Our total liability to you for any claim shall not exceed the amount paid by you for the specific order in question.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
